Terms & Conditions - the basics

General Terms and Conditions of Premium Bike Tours LLC

Date of instatement: 8th of July 2025

 

1. Scope & Acceptance

These terms apply to all Premium Bike Tours LLC tours (PBT) and can change at any time. Participation requires reading and agreeing to both PBT’s terms and those of the local tour operator, MPS IRIS BV in the Netherlands 

 

2. Reservations

Your reservation will be made by you on the PBT booking website. You need to receive an invitation from PBT to be able to do this first. PBT will then send you an agreement and invoice by e-mail, which entails a first payment that needs to be paid within 10 days, if not otherwise agreed upon by PBT. The reservation is made by paying the deposit.

The invoice you receive should also be used to pay the second payment, due 90 days before the tour starts. 

After this first payment, the cancellation rules apply! Your first payment is non-refundable under any conditions. 

Confirmation of the receipt of your deposit is emailed and should be received before making other travel arrangements.

Privacy Policy applies to all collected data.

 

3. Payments

The first payment is due within 10 days of receiving the invoice; the final payment is 90 days before travel.

 

4. Cancellations & Refunds

All cancellations and refund requests must be provided in writing.

 

Until 8 months before the tour start:

Your first payment is your cancellation fee

 

Between 8 months and 6 months before tour start:

The cancellation fee is 50% of your tour costs. You will receive an invoice to pay the difference between your first payment and 50% of the tour costs.

Between 6 months and 3 months before the tour start:

The cancellation fee is 80% of your tour costs. You will receive an invoice to pay/receive the difference between payments made and 80% of the tour costs. 

 

Between 3 months and 1 month before the tour starts:

The cancellation fee is 90% of your tour costs. You will receive an invoice to pay/receive the difference between payments made and 90% of the tour costs. 

1 month before the tour starts, the cancellation fee is 100% of your tour costs. You will receive an invoice to pay the difference between the payments made and 100% of the tour costs.

If canceled by the operator, you will receive a full refund of payments made. There is no option to charge PBT or MPS IRIS BV for any additional costs you incurred. 

Any refund will be made in terms of paying back the exact EU amount that PBT received for the tour costs. 

5. Liability Provisions

5.1 Carrier Liability

●     Not responsible for injury, death, or property loss due to unavoidable events (e.g., fire, explosion, vermin, weather).

●     Liability limited under Dutch Civil Law (BW 8:518; BW 8:983).

●     Compensation capped at the rental value of the ship.

●     Not liable for delays or vessel substitutions due to unforeseen circumstances.

5.2 Customer & Guest Liability

Travelers are responsible for damages they or their guests cause unless due to the carrier's fault.

5.3 Additional Liability Clauses

●     Force Majeure: No liability for failure due to uncontrollable events (natural disasters, political unrest, pandemics).

●     Limitation of Liability: Damages limited to the travel package cost; indirect or punitive damages excluded.

●     Indemnification: Travelers hold harmless the organizers for claims arising from their conduct.

●     Insurance Requirement: Travelers advised to obtain medical, trip-interruption, and liability coverage.

●     Assumption of Risk: Travelers accept inherent risks of international travel and physical activities.

●     Waiver of Liability: Right to claim damages waived except for gross negligence or willful misconduct.

●     Medical Authorization: Organizers authorized to seek emergency medical treatment on travelers’ behalf.

6 Enhanced Legal Protection Clauses

Chargeback & Refund Policy: Refunds only per cancellation timelines and force majeure; disputes must be addressed before initiating chargebacks.

Third-Party Supplier Disclaimer: Organizers act as intermediaries; not liable for third-party performance, delays, or omissions.

Itinerary Flexibility Clause: Itineraries subject to change; substitutions of equal or greater value may occur without refund
 

Health & Fitness Declaration: Travelers confirm they are medically and physically fit for all activities and agree to consult a physician as needed.
 

7. Connecticut Compliance

Consumer Protection: Compliant with Connecticut Unfair Trade Practices Act (CUTPA).

 

Payment Protections: No credit-card surcharges under CT Public Act 99-88.

 

Insurance Licensing: Travel insurance offered only by a licensed Connecticut producer.

 

Data Privacy: Personal data used solely for travel coordination; stored securely; not shared without consent except as required by law.

 

Accessibility & Non-Discrimination: Services provided without bias; reasonable accommodations available upon request.

Governing Law: Dutch law governs onboard operations; Connecticut law governs U.S. bookings.

 

Jurisdiction: Disputes resolved in Hartford County, CT courts unless otherwise agreed.

 

8. Complaints & Disputes

Service complaints must be reported promptly after discovery.

Invoice disputes must be submitted within 10 business days of receipt.

Disputes are subject to the governing law and venue specified above.

 

9. Force Majeure

Neither PBT or MPS IRIS BV are liable for delays or cancellations due to unforeseeable events (e.g., natural disasters, war, strikes, epidemics, government action). No refunds provided for force majeure events.

 

10. Special Diets

Requests must be noted during the reservation. PBT and MPS IRIS are not required to accommodate, but do serve Vegetarian, lactose-free, gluten-free, and gluten-free options, with the remark that a 100% gluten-free diet is not possible due to the circumstances of the food preparation and serving. 

 

11. Travel Insurance & Bicycle Protection

PBT recommends taking care of Cancellation and Travel insurance as soon as you pay your first payment! 

You do not need to add insurance for the bike, but do take care of insurance for yourself, in case you have an accident while cycling. This should be part of your Travel insurance. 

 

However, if you are to blame for losing/damaging the bike, for instance, if you leave it unlocked, the MPS IRIS might decide to ask you for the costs of repair or replacement. This is not insurable. 

 

12. SMS Consent

Providing your phone number and opting in allows PBT to send SMS/MMS/WhatsApp updates/offers. 

 

13: Operator Cancellations

Trip canceled due to flooding, low participation, structure repairs, etc.—full refund of tour cost, minus card fees. Airfare is the client's responsibility. 

Force Majeure, If canceled by PBT or MPS IRIS BV—standard refund; if canceled by client—even during Covid—standard cancellation policy applies.

14. Payment Methods

All payments are securely processed via Stripe, a trusted global payment provider. Travelers from the United States, Canada, Australia, New Zealand, and other regions can choose from a range of available payment methods depending on their country, currency, and device. These may include:

  • Credit or Debit Cards (Visa, Mastercard, American Express)
     

  • Bank Transfers (SEPA or wire transfer, where supported)
     

  • Digital Wallets such as Apple Pay, Google Pay, or Link by Stripe
     

The exact payment options shown during checkout are automatically determined by Stripe based on your location and the selected currency. We recommend using credit cards or digital wallets for the fastest and most seamless payment experience.

We do not charge any additional fees for using a specific payment method. However, your bank or card issuer may apply foreign transaction fees or currency conversion charges, especially if your account is in a different currency (e.g., USD, CAD, AUD, NZD) than the one used at checkout (EUR). These fees are set by your financial institution and are your responsibility.

Please note that all payments are collected in euros (EUR). If you are paying in a different currency, your total will be converted at the exchange rate provided by your bank or card provider at the time of payment. This means the final amount you see in your local currency is calculated in real-time at checkout.

If your booking involves multiple payments (e.g., a deposit and a final payment), the exchange rate may differ between the date that you pay your deposit and the date of your final payment.

15. Privacy Policy

All data collected (website, cookies, email, social) is governed by Premium Bike Tours' Policies.
